Report and Recommendation that Defendant's request for summary judgment on the First Cause of Action be DENIED. However, I recommend that Defendant's motion for summary judgment on the Second Cause of Action be GRANTED. To the extent Plaintiff's Third Cause of Action is a claim for unjust enrichment damages under § 1333.63 of the Ohio Uniform Trade Secrets Act, summary judgment should be GRANTED. Finally, and in the alternative, I recommend that Defendant's motion for judgment on the pleadings on the Third Cause of Action, to the extent it asserts a common law unjust enrichment claim, should be GRANTED.
