		order Order on Motion for Settlement Wed 12/13 11:01 AM ORDER granting15 Motion for Settlement. In accordance with Cheeks v. Freeport Pancake House , 796 F.3d 199 (2d Cir. 2015), the Court has scrutinized the parties' Settlement Agreement and finds that it is fair and reasonable. The Court's determination includes findings that the fee allocated to Plaintiffs' counsel (including costs) is likewise fair and reasonable. Therefore, the parties' Settlement Agreement is hereby approved. However, the Court declines to retain ancillary jurisdiction over this matter for the sole purpose of enforcing the Settle Agreement (should such enforcement ultimately be necessary). See Brandner Corp. v. V-Formation, Inc. , 98 F. App'x 35, 37 (2d Cir. 2004) ("As a general rule, a federal district court does not retain jurisdiction to enforce a settlement agreement...."). Therefore, the Parties are directed to resubmit their proposed Stipulation of Dismissal excising this jurisdictional language (in any event the proposed Stipulation was not executed by both parties and would therefore need to be resubmitted in any event).
