ORDER Striking Notice of Removal -- On June 15, 2017, this case was remanded to New York State Supreme Court, Richmond County, pursuant to 28 U.S.C. § 1447(c). See Dkt. Entry No.8 . Under 28 U.S.C. § 1447(d), "An order remanding a case to the State court from which it was removed is not reviewable on appeal or otherwise...." By operation of § 1447(d), the Court "divest[s]... [itself] of jurisdiction upon mailing of a remand order based on section 1447(c) grounds to the state court." Shapiro v. Logistec USA, Inc. , 412 F.3d 307, 312 (2d Cir. 2005) (internal citations and emphases omitted). A Certified Copy of the Remand Order was mailed to New York State Supreme Court on June 15, 2017. See June 15, 2017 Order of Remand. Accordingly, as the Court lacks jurisdiction over this matter, the Notice of Removal9 is stricken. SO ORDERED by Chief Judge Dora Lizette Irizarry on 12/20/2017.
