TEXT ORDER adopting16 Rule 26(f) Report with the following clarifications/modifications to which the parties agreed at the Initial Pretrial Conference held this day: (1) the Court makes no findings about the matters described in Paragraph 2 and does not adopt Paragraph 6; (2) the Standard case-management track established by Local Rule 26.1(a)(1) shall apply, modified only to provide for a six-month (rather than a four-month) discovery period, to allow for six (rather than four) depositions for each side, and to add a per-party limit of 15 requests for production under Federal Rule of Civil Procedure 34; (3) the parties shall exchange initial disclosures required by Federal Rule of Civil Procedure 26(a)(1) by 01/08/2018; (4) the parties shall file any motion seeking leave to amend pleadings and/or to add parties by 02/28/2018, with any such motions filed after that date subject to Federal Rule of Civil Procedure 16(b)(4), as well as Federal Rule of Civil Procedure 15(a)(2), but with the understanding that the allowance of any party's motion for leave to amend and/or to add parties generally would constitute "good cause" under Federal Rule of Civil Procedure 16(b)(4) for a responsive amendment/addition motion by the other party; (5) the parties shall file a joint notice on or before 02/28/2018, setting out their position(s) about mediation, including any agreement reached about whether the Court should order mediation, who should serve as the mediator, and when mediation should occur; (6) Plaintiff shall serve any expert disclosures required by Federal Rule of Civil Procedure 26(a)(2)(B) and (C) by 04/18/2018; (7) Defendant shall serve any expert disclosures required by Federal Rule of Civil Procedure 26(a)(2)(B) and (C) by 05/18/2018; (8) the parties shall complete discovery by 06/15/2018; (9) the parties shall consult about the protective order described in Paragraph 8.a.; (10) with Plaintiff's agreement, the Court adopts Paragraph 8.b., as the Court's own order, pursuant to Federal Rule of Evidence 502(d) and (e); and (11) both parties have agreed to electronic service of disclosures, as well as discovery requests and responses. TEXT ORDER declining to take any action on5 Response in Opposition to Defendants' Notice of Removal. In5 Response, Plaintiff argued that the Court should order sanctions against Defendants under Federal Rule of Civil Procedure 11. The basis for Plaintiff's arguments in that regard do not appear well-taken, but rather seem to reflect a misapprehension of the process for special appearances by counsel not admitted in this Court, the matters to which the consultation requirements of Local Rule 6.1 apply, and the timing rules for the filing of a responsive pleading in the removal context, as well as an over-reaction by Plaintiff to an inadvertent mistake by defense counsel in describing service of1 Petition as having occurred via both mail and e-mail, when, in fact, service (at least initially) occurred only by mail. In any event, Plaintiff must file a proper motion under Federal Rule of Civil Procedure 11 with a supporting brief before the Court would entertain sanctions under that rule based on the allegations made in5 Response. Fed. R. Civ. P. 11(c)(2) (stating that "[a] motion for sanctions must be made separately from any other motion" and generally prohibiting filing of motion for sanctions until 21 days after service on party from whom sanctions are sought to allow that party an opportunity to take corrective action); Local Rule 7.3(a) and (j) Related [+].
