RELATOR'S NOTICE OF VOLUNTARY DISMISSAL WITHOUT PREJUDICE PURSUANT TO FRCP 41: Relator, Christine Bouquin, hereby gives Notice that this action is dismissed without prejudice pursuant to FRCP 41(a)(1). The Complaint has not been served and no Answer or motion for summary judgment has been filed. This action was brought pursuant to the False Claims Act. Following the United States of America's declination of the matter, this Court Ordered, on January 9, 2018, that the Complaint be unsealed thirty days after entry of the Order. In the Court's Order unsealing the Complaint, the Court Ordered that "[s]hould the relator or the defendants propose that the Complaint or any of its allegations be dismissed, settled, or otherwise discontinued, or that defendants be dismissed from the case, the moving party (or parties) must solicit the written consent of the government before applying for Court approval." The United States consents with this Notice of Dismissal so long as the action is dismissed without prejudice as to the United States. IT IS HEREBY ORDERED that the above - captioned action is dismissed without prejudice. Fed. R. Civ. P. 41(a)(1). The Clerk of Court is respectfully directed to close this case. ORDER: The 90-day time limit to serve the complaint set out in Federal Rule of Civil Procedure 4(m) therefore commenced on February 12, 2018, and expired on May 14, 2018. See Ping Chen ex rel. United States v. EMSL Analytical, Inc., 966 F. Supp. 2d 282, 306 (S.D.N.Y. 2013) (applying Rule 4(m) to service of an unsealed qui tam complaint). Relator has not filed proof of service, and apparently has not even requested issuance of a summons with which to serve Defendants. Accordingly, this action will be dismissed without prejudice unless Relator, within two weeks from the date of this order, that is, on or before May 30, 2018, either (1) files proof that the complaint was timely served on Defendants or (2) shows cause in writing why a further extension of the time limit for service is warranted. ORDER. IT IS ORDERED THAT: 1. The Complaint shall be unsealed thirty days after entry of this Order, and, in the event that the relator has not moved to dismiss this action, service upon defendants by the relator is authorized as of that date. 2. Except for the Complaint, this Order and the Notice of Decision to Decline Intervention, all other contents of the Court's file in this action shall remain under seal and not be made public or served upon the defendants. 3. Upon the unsealing of the Complaint, the seal shall be lifted as to all matters occurring in this action subsequent to the date of this Order. 4. The parties shall serve all pleadings and motions filed in this matter, including supporting memoranda, upon the government. The government may order any transcripts of depositions. The government may seek to intervene with respect to the allegations in the relator's Complaint, for good cause, at any time. 5. All further orders of this Court in this matter shall be sent to the government by the relator. 6. Should the relator or the defendants propose that the Complaint or any of its allegations be dismissed, settled or otherwise discontinued, or that the defendants be dismissed from the case, the moving party (or parties) must solicit the written consent of the government before applying for Court approval.
