ORDER: On August 28, 2018 the court granted the July 31, 2018 motion to dismiss of defendant Blue Star Residential Len ding, Inc. ("Blue Star") under Fed. R. Civ. P. 12(b)(6). The court also granted plaintiff 28 days from the date the order was filed to file an amended complaint. The court's order provided that, if plaintiff failed to replead, this action would be dismissed as to Blue Star based on its July 31, 2018 motion. Because plaintiff has failed to replead, the court, by Rule 54(b) final judgment filed today, dismisses plaintiffs action against Blue Star with prejudice.
