DEFAULT JUDGMENT AND PERMANENT INJUNCTION ORDER. The Court HEREBY ORDERS that Defendants are liable for willful federal trademark counterfeiting and infringement under 15 U.S.C. § 1114, the use of false designation of origin under 15 U.S.C. § 1125(a), cybersquatting under 15 U.S.C. § 1125(d)(1), and willful copyright infringement under 17 U.S.C. § 504(c)(2), and that this Default Judgment and Permanent Injunction Order is entered against Defendants, and as further set forth in this Default Judgment and Permanent Injunction Order. IT IS FURTHER ORDERED that, pursuant to 15 U.S.C. § 1117(c)(2), Plaintiff UMG is awarded statutory damages for willful trademark counterfeiting in the amount of two million dollars and no cents ($2,000,000.00) against Defendants for each of the Grooveshark Marks, for a total award of statutory damages in the amount of four million dollars and no cents ($4,000,000.00) against Defendants; and IT IS FURTHER ORDERED that, pursuant to 15 U.S.C. § 1117(d), Plaintiff UMG is awarded statutory damages for willful cybersquatting in the amount of one hundred thousand dollars and no cents ($100,000.00) for the Infringing Domain Name against Defendants; and IT IS FURTHER ORDERED that, pursuant to 17 U.S.C. § 504(c)(2), Plaintiffs are awarded statutory damages for willful copyright infringement in the amount of one hundred and fifty thousand dollars and no cents ($150,000.00) for each ofthe eighty-four (84) sound recordings infringed by Defendants for a total award of statutory damages in the amount of twelve million, six hundred thousand dollars and no cents ($12,600,000.00), and as further set forth in this Default Judgment and Permanent Injunction Order. IT IS FURTHER ORDERED that, pursuant to Federal Rule of Civil Procedure 65(d), 17 U.S.C. § 502, 15 U.S.C. §§ 1116 & 1125(d), 28 U.S.C. § 1651(a), this Court's inherent equitable powers, and in order to give practical effect to the Permanent Injunction, Defendants, their officers, agents, servants, employees, or attorneys, and any persons in active concert or participation with them are hereby permanently RESTRAINED and ENJOINED from allowing the continued use, or the transfer to any person other than Plaintiffs, of the Infringing Domain Name. IT IS FURTHER ORDERED that the Infringing Domain Name be immediately transferred to Plaintiffs' control. PRELIMINARY INJUNCTION: On February 22, 2016, Dkt. No. 9, the Court informed the parties that if Defendants failed to submit answering papers on the order to show cause by February 24, 2016, or otherwise failed to indicate a willingness to participate in this litigation, the Court would grant the request for a preliminary injunction. In response to the Court's Order dated February 25, 2016, Dkt. No. 9, Plaintiffs confirmed that they had served Plaintiffs with the Court's February 22 Order. Dkt. No. 12. Therefore, in light of the Defendants' failure to submit answering papers or otherwise indicate a willingness to participate in this litigation: IT IS HEREBY ORDERED that, pursuant to Federal Rule of Civil Procedure 65, Section 34 of the Lanham Act, the All Writs Act, and this Court's inherent equitable powers, that Defendants, their officers, agents, servants, employees, confederates, and any persons in active concert or participation with them, including but not limited to domain name registrars, domain name registries, and Internet service providers ("ISPs"), are preliminarily enjoined from: 1. ORDER: Pursuant to a Court Order dated February 9, 2016, the above-captioned matter was sealed. On February 10, 2016, the Court issued a temporary restraining order against Defendants and issued an order to show cause for a preliminary injunction. Defendants were served on February 12, 2016 via email, as authorized by the Court. The deadline for Defendants' answering papers on the order to show cause passed on Thursday, February 18, 2016. No opposition papers were filed and, as of February 22, 2016, Defendants have failed to notice an appearance. ORDER. On February 10, 2016, the Court issued a temporary restraining order against Defendants and issued an order to show cause for a preliminary injunction with a hearing scheduled for February 25, 2016. Defendants were served with these documents on February 12, 2016. Defendants did not submit opposition papers by the deadline indicated in the order to show cause and have failed to notice an appearance in this case. Pursuant to the Court's order dated February 22, 2016, the Court informed the parties that if Defendants failed to submit answering papers on the order to show cause by 5:00 p.m. on February 24, 2016, or otherwise failed to indicate a willingness to participate in this litigation, the Court would grant the request for a preliminary injunction and would adjourn the preliminary injunction hearing scheduled for February 25, 2016. As of February 25, 2016, Defendants have failed to submit answering papers on the order to show cause and have failed to otherwise indicate a willingness to participate in this litigation. However, the Court's February 22, 2016 directed Plaintiffs to serve a copy of that order on Defendants and provide the Court with proof of service by Wednesday, February 24, 2016. The Court has not yet received such proof of service. Because Defendants were served with the original temporary restraining order and order to show cause for a preliminary injunction and have not submitted answering papers or filed a notice of appearance, the Court will adjourn the preliminary injunction hearing scheduled for this afternoon, February 25, 2016. However, the Court will not grant Plaintiffs' request for a preliminary injunction until it receives proof of service with respect to the Court's February 22, 2016 order. So ordered.
