TEXT ORDER denying 43 Motion for Reconsideration: On August 2, 2017, the Court issued an order adopting the Magistrate Judge's Report and Recommendation ("R & R") and summarily dismissing Plaintiff's amended complaint without prejudice. See ECF No. 40 . On September 25, 2017, Plaintiff filed the instant "Motion to re-open case." See ECF No. 43 . Based on the timing of the motion, the Court construes it as a motion made pursuant to Federal Rule of Civil Procedure 60(b). See generally In re Burnley, 988 F.2d 1, 2-3 (4th Cir. 1992) (indicating that "[i]n cases where a party submits a motion [that] is unnamed and does not refer to a specific Federal Rule of Civil Procedure," a court should construe the motion under Rule 60(b) if it is not filed within the time for filing a Rule 59(e) motion). Rule 60(b) provides for an extraordinary remedy that should not be awarded except under exceptional circumstances. Mayfield v. Nat'l Ass'n for Stock Car Auto Racing, Inc., 674 F.3d 369, 378 (4th Cir. 2012). It allows a court to "relieve a party or its legal representative from a final judgment, order, or proceeding" for six reasons: (1) "mistake, inadvertence, surprise, or excusable neglect"; (2) newly discovered evidence; (3) fraud; (4) a void judgment; (5) a satisfied, released, or discharged judgment; or (6) "any other reason that justifies relief." Fed. R. Civ. P. 60(b). "A party that fails to act with diligence will be unable to establish that his conduct constituted excusable neglect pursuant to Rule 60(b)(1)." Robinson v. Wix Filtration Corp. LLC, 599 F.3d 403, 413 (4th Cir. 2010). Before establishing that one of the six subparts is applicable, a party moving for relief under Rule 60(b) "must make a showing of timeliness, a meritorious defense, a lack of unfair prejudice to the opposing party, and exceptional circumstances." Werner v. Carbo, 731 F.2d 204, 206-07 (4th Cir. 1984). In her motion, Plaintiff states: "Plaintiff, pro se, was not considered by the Judge or the Court when the decision was being made according to their dismissal." ECF No. 40 . She appears to assert the Court should have considered her untimely objections to the R & R. However, other than asserting she "is NOT an attorney," Plaintiff has not explained why her objections were untimely, and therefore has not made a sufficient showing of "excusable neglect" under Rule 60(b)(1). Notably, the Magistrate Judge's R & R specifically notified Plaintiff when her objections were due. See R & R at p. 5. Moreover, Plaintiff has not made a sufficient showing that she is entitled to relief for any other reason under Rule 60(b). Accordingly, the Court DENIES Plaintiff's 43 motion to reopen.
