MEMORANDUM & ORDER [ADOPTING REPORT AND RECOMMENDATION]: By 37 Report & Recommendation dated 1/2/2018 (the "R&R"), Judge Bulsara recommended that the Court dismiss the Complaint without prejudice for lack of subject matter jurisdiction, and that Defendants' requests for sanctions be denied. Plaintiff 39 objected to the portion of the R&R recommending dismissal of the Complaint. The Court adopts the 37 R&R in its entirety. The Court grants Defendants' motions to dismiss the action without prejudice for lack of subject matter jurisdiction, and denies Defendants' requests for sanctions. The Court grants Plaintiff leave to file an amended complaint alleging facts supporting diversity jurisdiction within 60 days of this Memorandum and Order. SO ORDERED by Judge Margo K.
