MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey, on 4/10/2017. RE12 Amended Stipulation and Order Dismissing Action with Prejudice as to AIG Direct Insurance Services, Inc. On 4/7/17, I rejected the original stipulation by minute order and explained the problems with the stipulation. 11 . Plaintiff filed a new stipulation, but it looks identical to the last one I rejected, and it does not cure the problems that I identified in my minute order. Accordingly, the amended Stipulation and Order12 is DENIED for the same reasons the last one was. The stipulation still confusingly states that Martinez is dismissing this case "ONLY as to" AIG. In bold text. And ALL CAPS. This construction makes it appear that there are claims against some other defendant that are intended to survive this stipulated dismissal, but there aren't. The parties are cautioned AGAIN that any amended stipulation needs to simply dismiss the entire case with prejudice and not "as to AIG Direct Insurance Services, Inc." There are only two parties in this case: plaintiff Suzanne Martinez and defendant AIG Direct Insurance Services, Inc. Yet, when the parties settled this case, the stipulation confusingly states that Martinez is dismissing this case "ONLY as to" AIG. In bold text. And ALL CAPS. This construction makes it appear that there are claims against some other defendant that are intended to survive this stipulated dismissal, but there aren't. Accordingly, this stipulation 10 is DENIED without prejudice to the parties' ability to file an amended stipulation that dismisses this entire case with prejudice. Mr. Krieger is cautioned that, in the future, stipulated dismissals of claims in single-defendant cases should simply state that the case is dismissed with prejudice, each side to bear its own fees and costs.
