Accordingly, it is hereby ORDERED that this action will be dismissed without costs (including attorneys' fees) to either party on April 14, 2017 unless before that date one or more of the parties files a letter with the Court requesting that the action not be dismissed and stating the reasons why the Court should retain jurisdiction over this action in light of the parties' settlement. To be clear, any request that the action not be dismissed must be filed on or before April 14, 2017; any request filed thereafter may be denied solely on that basis. If the parties wish for the Court to retain jurisdiction over their settlement agreement, not later than April 7, 2017, they must submit the settlement agreement to the Court in accordance with Rule 5.A of the Court's Individual Practices, along with a request that the Court issue an order expressly retaining jurisdiction to enforce their settlement agreement. See Hendrickson v. United States, 791 F.3d 354 (2d Cir. 2015). The mediation referral order is cancelled, and Defendants motion to dismiss i s denied as moot. MEDIATION REFERRAL ORDER: This case, involving claims under the Copyright Act, 17 U.S.C. § 101 et seq., has been assigned to this Court for all purposes. In the Court's experience, cases involving copyright claims often benefit from early mediation. To that end, prior to a Rule 16(b) case management conference, the Court is referring this case to the Mediation Office for settlement purposes under Local Civil Rule 83.9. The parties are hereby notified that Local Rule 83.9 shall govern the mediation, and the parties are directed to participate in the mediation in good faith. No later than one week after the conclusion of all mediation in this case, the parties are directed to notify the Court whether they successfully resolved the case in mediation. The Court specifically requests a mediator with expertise in copyright matters be assigned. Briefing on Defendant's motion to dismiss is stayed pending completion of the mediation.
