ORDER denying25 Motion to Amend/Correct/Modify: Essentially two grounds are stated for the relief requested: that the parties "are scheduling multiple depositions in several states that impact the issues upon which expert witness testimony will likely be necessary" and that "due to upcoming holidays and the calendars of the parties, counsel, witnesses and experts," additional time is necessary "in order to allow sufficient time to obtain the relevant information, provide for review, and obtain expert reports." MSK Practice Standard (Civil) 6.1(b) provides that extensions of deadlines must be supported by a showing of "unanticipated and unavoidable" circumstances. The scheduling of depositions, even in multiple states, does not rise to this level, particularly where discovery in this case has been in progress for more than four months already. Nothing in the motion indicates why the depositions in question could not have been scheduled earlier. Similarly, the disruption caused by annual holidays cannot be an "unanticipated" event. Accordingly, the Court finds that the parties have not established good cause for the requested extension and the motion is denied without prejudice. by Chief Judge Marcia S. Krieger on 12/27/17.
