MEMORANDUM Opinion and Order Signed by the Honorable John J. Tharp, Jr on 4/22/2020: For the reasons stated in the accompanying memorandum opinion and order, American's motion to dismiss is denied with respect to the claims of certain individual plaintiffs and granted with respect to all other individual plaintiffs. Because the plaintiffs have had the opportunity to replead their claims and have done so at great length, the Court concludes that further amendment of the complaint would be futile. To the extent that the Second Amended Complaint fails to plead plausible claims as to individual plaintiffs, the dismissal of those plaintiffs is with prejudice. The parties are advised to confer on a case management plan and to submit an agreed plan for moving forward with the surviving claims (or highlighting the parties' disputes) by May 29, 2020.
