One defendant, Michael Maranda, apparently was served on February 11, 2019. He has not filed an answer or other response, nor has plaintiff sought a default or default judgment. There is no indication that the other defendants have been served. Plaintiff's counsel who filed the lawsuit withdrew, indicating that he thought that the parties had reached a settlement, but he plaintiff's counsel was not informed about the nature and scope of the settlement. This was in January 2020. Plaintiff's General Counsel took over. Still, there has been no progress with the lawsuit. Each time the Court has inquired about the lawsuit since then and has set deadlines for action, see, e.g., ECF Nos. 24 (2/11/20) and 35 (9/15/20), plaintiff provides a response on the date of the deadline telling the court about a settlement reached on February 22, 2019 with which plaintiff was still trying to get the defendant to comply, and plaintiff asks the Court not to dismiss the case, see, e.g., ECF Nos. 27 (2/21/20) and 36 (9/30/20). Plaintiff warns that if the Court dismisses the case, plaintiff "may be forced to pursue claims against Defendants for intentionally damaging Plaintiff's property and violating the settlement agreement." ECF No. 36. That response, like the previous one, gives no indication that any progress has been made in this strange lawsuit, nor does it provide any reason to expect that the situation is about to change. If there is a settlement, and if the defendants have not complied with it for a year and a half, it would indeed appear that a breach of contract action might be necessary. However, the notion that such a claim would be made in this case where it has not for the last year and a half, and that the parties would be in a position once more to drag on a federal court case for who knows how long, is not acceptable. One defendant, Green Mountain Electric Supply was dismissed by stipulation on April 30, 2019 at ECF No. 13.
