MINUTES OF IN CHAMBERS - ORDER RE OFFER OF JUDGMENT by Judge Dolly M. Gee: On 2/21/2019, Defendant City of Desert Hot Springs ("City") filed an Offer of Judgment pursuant to Federal Rule of Civil Procedure 6820 . On 2/23/2019, Defendant City filed an Objection, claiming that Defendant City was the only party that made the offer, Defendants Huerta and Franklin have not been properly served, and that the City was the only Defendant who consented to the entry of judgment against it22 . On 2/26/2019, Plaintiff filed a Response to the Objection, in which he (inter alia) insists that Defendant City made the offer on behalf of all Defendants and that Plaintiff is entitled to judgment against all Defendants pursuant to Federal Rule of Civil Procedure 6824 . The Court is deeply disappointed that counsel could not resolve this petty dispute among themselves, and there is no indication that they even attempted to informally do so. Thus, the Court ORDERS counsel for Plaintiff and for Defendant City and James to meet and confer in good faith and attempt to resolve this matter without the need for judicial intervention. The parties shall file a joint status report regarding their efforts to resolve this dispute by 3/8/2019. If the parties agree on a resolution, then they shall submit a proposed order along with their joint status report. If the parties do not agree on a resolution, then they shall propose the next steps for resolving their dispute.
