Mann stayed this case pending resolution of the underlying state court action and ordered the parties to file a joint letter apprising the court when the state action was resolved. On November 25, 2020, this Court denied a pre-motion conference letter with leave to renew once the stay was lifted. In direct contravention of Judge Mann's order, and this Court's Individual Practices, Defendant filed a motion to dismiss without first apprising the court of the status of the underlying state action and without first seeking a pre-motion conference. Accordingly, Defendant's motion21 is DENIED with leave to renew. No later than January 31, 2023, the parties shall file a joint letter apprising the Court as to the status of the state court action. If that matter is resolved, Defendant shall file a pre-motion conference letter or otherwise answer the complaint no later than January 31, 2023.
