order - Order (PAPERLESS or pdf attached) Tue 10/26 10:02 AM
PAPERLESS ORDER. During the September 22, 2021 Status Conference, the parties informed the Court that they reached a settlement. The parties also filed a Notice of Settlement [DE 53]. Based on those representations, the Court extended the stay in this case and gave the parties 30 days to file a stipulation of dismissal. DE 54. Although the parties recently filed a Stipulation of Dismissal With Prejudice [DE 55], the parties state that the stipulation is "subject to the right of either Plaintiff or Defendant to move the Court within sixty (60) days thereafter for the purpose of entering a stipulated form of final order or judgment; or, on good cause shown, to reopen the case for further proceedings." Id. at 1. The Court does not construe the filing at docket entry 55 as a stipulation of dismissal. Rather, the Court construes the filing as a motion for extension of time to file a stipulation of dismissal. The motion for extension of time is GRANTED, and the parties shall have sixty (60) days from the date of this Order to file a dismissal that complies with the Federal Rules of Civil Procedure. This case remains STAYED. Signed by Judge Robin L. Rosenberg on 10/26/2021. (cgs)
