ORDER granting in part34 Motion to Request Mediation. Defendant SUNY has requested, with plaintiff's consent, that this Court either conduct a settlement conference or waive SUNY's portion of the mediation fee, "which would otherwise have to be paid from taxpayer funds." DE #34 at 2. Given the very modest cost of court-annexed mediation, and the potential enormous savings of taxpayer dollars in the event a settlement is reached, this Court has been reluctant to waive the mediation fee in cases involving governmental defendants, who clearly can afford the $300 expense. Nevertheless, given the circumstances of this particular case, the Court will make an exception and will waive the fee for all parties.
