ORDER denying25 Motion for Summary JudgmentPlaintiff is Cindy Ng, a former employee of Defendant Varonis Systems, a data security company headquartered in New York. Plaintiff alleges that Defendant discriminated against her on the basis of sex and race and that her termination was retaliation for filing a complaint. Specifically, she alleges that she was treated less well than three white, male coworkers because she is an Asian woman.While certain discrete acts of alleged discrimination that occurred before September 1, 2018 may be time-barred, the parties do not dispute that Plaintiffs placement on a personal improvement plan and termination were within the statute of limitations. Because there are triable issues of fact as to whether Plaintiff was similarly situated to certain coworkers and whether Defendants actions were pretextual, the motion for summary judgment as to all claims is denied.Counsel will meet with the court for a status conference, to set a trial date or chart additional proceedings, on April 28, 2022, at 10:00 a, (HEREBY ORDERED by Judge Alvin K.
