ORDER: The Court now Orders as follows: 1. Defendants Salvatore Palella, Lorenzo Pellegrino, Giulio Profumo, Jonathan Hannestad, Justin Giuliano and the Chief Executive Officer of micromobility.com Inc., shall by May 8, 2025, each file a declaration under penalty of perjury, executed in conformity with 28 U.S.C. 1746, with a listing in full compliance with paragraph 1 of the April 17, 2025 Order. This requires each of the foregoing to "list... all electronic devices in their possession and control, including any and all smart phones, desktop computers, laptop computers, tablets, servers and electronic storage devices that contain data or communications from the relevant time period identified by the parties on the record." 2. By May 8, 2025 micromobility.com Inc. shall submit a declaration from the person most knowledgeable of micromobility.com Inc.'s use of electronic storage devices, including servers, cloud services, data storage services, desktop computers, laptop computers, tablets, smart phones, during the time period of November 15, 2017 to May 4, 2021 describing with particularity the electronic storage device, the period it was in use, whether it was sold, transferred, disposed of, erased, deleted or modified and its present whereabouts; the declaration shall set forth the date micromobility.com Inc. first subscribed to "Google Workspace" or its predecessor "G Suite" and any ending date to its subscription for these services. 3. By May 2, 2025, defendants shall show cause in writing why micromobility.com Inc. ought not be ordered to search for ESI in its possession or control of or relating to the nine so-called "custodians" identified in the plaintiffs' letter of April 28, 2025. (ECF 354 at 2-4.) 4. DEFENDANTS SALVATORE PALELLA, LORENZO PELLEGRINO, GIULIO PROFUMO, JONATHAN HANNESTAD, JUSTIN GIULIANO AND MICROMOBILITY.COM INC. AND THEIR COUNSEL ARE ADVISED THAT THE FAILURE TO FULLY COMPLY WITH THIS ORDER AND THE ORDER OF APRIL 17, 2025 MAY RESULT IN PUNISHMENT FOR CONTEMPT OF COURT AND ANY SANCTIONS ENUMERATED IN RULE 37, FED.
