MINUTE ORDER: Pending before the Court is Plaintiff's motion for an order specially appointing counsel as a person authorized to complete service of process. Dkt.17 . Plaintiff filed this lawsuit against several Cuban entities under the Cuban Liberty and Democratic Solidarity Act of 1996. Thus far, Plaintiff's efforts to serve process on Defendants have been unsuccessful. Because Defendants are (allegedly) agencies or instrumentalities of Cuba, they are amenable to service under the Foreign Sovereign Immunities Act ("FSIA"). As relevant here, the FSIA permits service on an agency or instrumentality of a foreign state "by any form of mail requiring a signed receipt, to be addressed and dispatched by the clerk of the court to the agency or instrumentality to be served." 28 U.S.C. § 1608(b)(3)(B). But Plaintiff has hit a snag in its efforts to serve Defendants under this provision. DHL, which is Plaintiff's courier of choice (and of last resort), will deliver packages to Cuba only if those packages are dropped off in person at a DHL facility in Miami. And the Clerk of Court, while accommodating, is unable to hand-deliver the packages to Florida on Plaintiff's behalf, as much as she might enjoy a visit to South Beach. That is where Plaintiff's motion comes in. Plaintiff asks the Court to designate its counsel as a person authorized to complete service, so that counsel can receive the dispatch from the Clerk of Court and pass the materials along to DHL in Miami. As Plaintiff points out, Federal Rule of Civil Procedure 4(c)(3) permits the court to order that "service be made... by a person specially appointed by the court." Plaintiff has not identified any authority, however, supporting the proposition that Rule 4(c)(3) can be superimposed on the FSIA service provision in the way that Plaintiff suggests. The text of the FSIA, moreover, would seem to require that the Clerk of Court "dispatch" the service materials through the mail directly "to the agency or instrumentality to be served," without any party to the case acting as an intermediary. 28 U.S.C. § 1608(b)(3)(B). And the Court is unconvinced, at least on the present record, that the general provisions of Rule 4 create any exceptions to the specific requirements of the FSIA. The Court is sensitive to the challenges that Plaintiff has encountered in its attempts to serve Defendants, but, unless Plaintiff can demonstrate that its proposed solution is permitted under the FSIA, Plaintiff might simply need to find another way to effect service. For these reasons, it is hereby ORDERED that Plaintiff's motion is DENIED without prejudice. Plaintiff may renew its motion if it can provide authority supporting the proposition that its proposed approach is consistent with 28 U.S.C § 1608(b)(3)(B) or, alternatively, may pursue another means of effecting service.
