SCHEDULING ORDER: The Court having reviewed the submission in support of the motion for settlement approval [DE 20] it appears that contemporaneous billing records were not provided and therefore the Court does not have sufficient information upon which to conduct a proper Cheeks review. See Cabrera v. Rose Hill Asset Mgmt. Corp. , No. 20 CIV. 2699 (AT), 2022 WL 3328086, at *2 (S.D.N.Y. July 5, 2022) (quotations omitted) (citing Wolinsky v. Scholastic Inc. , 900 F. Supp. 2d 332, 336 (S.D.N.Y. 2012) ("Where the proposed settlement provides for the payment of attorneys fees... counsel must submit evidence providing a factual basis for the award, including contemporaneous billing records documenting, for each attorney, the date, the hours expended, and the nature of the work done.") Accordingly, Plaintiffs' counsel is directed to file on ECF all contemporaneous billing records on or before October 19, 2022. A Fairness Hearing has been set for October 31, 2022, at 2:30 PM before before Magistrate Judge James M. Wicks via the Court's video Zoom to further explore the bona fides of the dispute and whether the proposed settlement is fair and reasonable.
