ORDER denying without prejudice26 Motion to Compel; granting28 Motion to Adjourn Conference. According to DE28 , the parties are requesting adjournment of the 2/10/2023 Settlement Conference with the undersigned in light of the parties' representation that they intend to engage in "an earnest attempt to resolve this action without the need for the Courts involvement" and that "[b]oth sides are hopeful that the meet and confer process will be productive." The Court GRANTS the joint request to adjourn the 2/10/2023 Settlement Conference sine die and ORDERS the parties to provide the Court with an update on the status of their settlement discussions by 2/24/2023. Furthermore, in light of the parties' joint representation in DE28 regarding their ongoing settlement discussions, the Court is exercising its discretion to DENY WITHOUT PREJUDICE the pending motion concerning two non-party subpoenas at DE26 .
