ORDER GRANTING DEFENDANTS SECOND MOTION TO DISMISS: ORDER granting13 Motion to Dismiss for Failure to State a Claim. The Court grants UMCs second motion to dismiss Fergasons amended complaint. Fergason failed to state a claim upon which relief can be granted pursuant to Federal Rule of Civil Procedure 12(b)(6). The Court therefore dismisses Fergason's amended complaint for failure to state a claim upon which relief can be granted. And because Fergason previously had an opportunity to amend his deficient complaint, the Court finds that any further amendments would be futile. ORDER: Before the Court is the parties' Joint Motion for Modification of Scheduling Order. Dkt. No.27 . The motion is granted in part. The Court's scheduling order provides that "the parties may not agree to extend [the expert-objection] deadline beyond the dispositive motion deadline. " Dkt. No.21 at 5. Therefore, the Court declines to grant an extension of the expert-objection deadline. The parties may, however, agree among themselves to extend the deadlines for initial and responsive expert designations so long as (1) any extensions do not affect the trial setting, dispositive-motion deadline, or expert-objection deadline, and (2) the parties provide written notice to the Court of any agreed extensions. Lastly, the Court grants the parties' request to extend the deadline for amendment of pleadings from June 1, 2023, until August 1, 2023. All deadlines contained in the Court's scheduling order (Dkt.
