Minute Order
Wed 07/06 11:14 AM
MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 7/6/2022. IT IS HEREBY ORDERED that Plaintiff State Farm Fire & Casualty Company ("Plaintiff") show cause by July 20, 2022, as to why the Court should not dismiss this action for failure to satisfy the diversity jurisdiction requirements set forth in 28 U.S.C. § 1332. To show Defendant Harris Law Firm, LLP's ("Defendant's") diversity, Plaintiff broadly states that Defendant "is a Limited Liability Company, licensed and domiciled with Nevada with its principal place of business in Las Vegas, Nevada." (Compl. 5, ECF No. 1 ). However, that broad statement fails to adequately allege Defendant's citizenship for purposes of diversity jurisdiction. See NewGen, LLC v. Safe Cig, LLC , 840 F.3d 606, 611 (9th Cir. 2016) (explaining that, to properly plead diversity jurisdiction for a limited liability company, the citizenship of all members must be pled). Accordingly, to ensure that the Court has subject matter jurisdiction over this case, Plaintiff must file a Notice by July 20, 2022, listing the citizenship for all of Defendant's members/owners (or partners, since Plaintiff, at various times, refers to Defendant both as an LLP and an LLC). (Copies have been distributed pursuant to the NEF - KB) |
