STIPULATION OF SETTLEMENT AND ORDER OF DISMISSAL WITH PREJUDICE PURSUANT TO RULE 41(a)(l)(A)(ii) NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the Parties, through the undersigned, as follows: I. In consideration of payment of the sum set forth in paragraph "2" below, this action is hereby dismissed with prejudice pursuant to Rule 41(a)(l)(A)(ii), without fees, costs, or expenses in excess of the amount specified in paragraph "2". 2. The City of New York shall pay TWENTY EIGHT THOUSAND FIVE HUNDRED DOLLARS AND ZERO CENTS ($28,500.00) in full satisfaction of all claims for attorneys' fees, costs, and expenses, incurred or accrued in connection with school year 2020-21, including IH Case No. 200531 and the instant federal action. ORDER OF DISMISSAL: The Court having been advised (Docket No. 13) that all claims asserted herein have been settled in principle, it is ORDERED that the above-entitled action be and is hereby dismissed and discontinued without costs, and without prejudice to the right to reopen the action within thirty days of the date of this Order if the settlement is not consummated. To be clear, any application to reopen must be filed within (30) thirty days of this Order; any application to reopen filed thereafter may be denied solely on that basis. Further, if the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the same (30) thirty-day period to be "so ordered" by the Court. Per the Court's Individual Rules and Practices for Civil Cases, unless the Court orders otherwise, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record.
