Minute Order
Tue 01/24 7:44 PM
MINUTE ORDER The Court has communicated with Magistrate Judge Varholaks Chambers about scheduling in the two related cases. This case was referred to Judge Varholak for a Scheduling Conference when the case was assigned to Judge Domenico. This Court typically does not refer scheduling conferences or most other pretrial matters to magistrate judges. The Scheduling Conference with Judge Varholak is vacated. The first case, 20cv3501 has a specific schedule leading up to a trial date of October 16, 2023. See ECF No. 57 in that case. If the cases are truly related cases, then it would seem that the schedule from that case might suffice for the present case as well. If so, then there is no need for a Scheduling Conference in this case. However, if for some reason the schedule from the first case cannot serve the second case, then please contact Chambers and set a Scheduling Conference in the present case with this Court at the earliest available date. The Court will not be available between January 30 and February 17, 2023, and February 20, 2023 is a court holiday. Please pick a date among February 21-24 and February 27 and 28, and Chambers will give you a specific time on your date of choice. You may set this Scheduling Conference for a telephonic hearing if you prefer not to travel to Denver for an in-person conference. by Judge R. Brooke Jackson on 1/24/2023. Order on Motion for Extension of Time to File
Mon 01/23 5:53 PM
ORDER denying22 Motion for Extension of Time to File re22 Unopposed MOTION for Extension of Time to Conduct Scheduling Conference and Related Deadlines in Light of Defendant's Proposed Motion to Dismiss . The Court discouraged the filing of the motion to dismiss, but apparently the defendant plans to file it anyway. The present motion just builds unnecessary delay into the case. The Court sua sponte extends the deadline for the Rule 26(f) conference to January 27, 2023. The Court does not extend the deadline for submission of a proposed scheduling order or the date of the scheduling conference that apparently has been set with Magistrate Judge Varholak. by Judge R. Brooke Jackson on 1/23/2023. Text Only Entry(rbjlc5, ) |

Minute Order
Mon 01/16 10:22 AM
MINUTE ORDER: The Court has reviewed the parties' letter of intent and response. The Court agrees that the proposed motion presents an issue of law. However, it appears based upon our review of the law cited in your letters that the motion to dismiss would very likely be denied. See U.S. v. Sarubin, 507 F.3d 811, 815 (4th Cir. 2007); U.S. v. Jersey Shore States Bank, 781 F.2d 974, 979-80 (3d Cir. 1986); Shelter Mut. Ins v. Gregory, 555 F. Supp. 2d 922, 933 (M.D. Tenn. 2008). Therefore, briefing and deciding a motion to dismiss would appear to be a waste of resources, including judicial resources, and the Court discourages your filing of the motion.
