Order on Motion to Dismiss for Failure to State a Claim
Tue 05/16 8:44 AM
District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. This case began as two separate actions against the Massachusetts Department of State Police. Prior to the consolidation, the Department filed a motion to dismiss the original complaint in each of the separate actions. After the Court allowed consolidation on April 24, 2023, Plaintiffs filed an amended complaint on May 12, 2023. Those original motions to dismiss, 1:23-cv-10146-LTS Doc. No. 7 and 1:22-cv-12013-LTS Doc. No. 13, are TERMINATED AS MOOT. The Department shall, within the time provided under Federal Rule of Civil Procedure 15(a)(3), either file a new motion to dismiss the amended complaint with a revised consolidated memorandum or, if they wish to rely upon the memoranda supporting the original motions to dismiss, file a motion to dismiss the amended complaint stating that they wish to rely upon the original memoranda.
