ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE - Defendants Motion to Dismiss is GRANTED and Plaintiffs trade dress dilution and Texas Theft Liability Act and unfair competition claims are dismissed without prejudice. Plaintiff shall have 21 days from the date of this Order to file an Amended Complaint to replead its trade dress dilution and Texas Theft Liability Act and unfaircompetition claims consistent with the Findings, Conclusions, and Recommendation of the United States Magistrate Judge. No. 541) on Plaintiff's Motion for Partial Summary Judgment (Doc. No. 305) and Defendants' Motion for Partial Summary Judgment (Doc. No. 311). The FCR recommends this Court grant in part and deny in part both Plaintiffs Motion and Defendants' Motion.Accordingly, Plaintiff's Motion for Partial Summary Judgment is DENIED in its entirety. ELECTRONIC AMENDED SCHEDULING ORDER Setting Trial Date and Pretrial Deadlines. The Court is in receipt of the parties' Joint Notification Regarding Trial Setting (Doc. No. 661). The Court has carefully considered the parties' respective positions and the requested trial settings in light of the Court's very busy docket and trial calendar. The Court sets this case for trial on the three-week docket beginning February 1, 2027 . Although the Court makes every effort to give as much notice as possible, counsel and the parties shall be ready for trial on two (2) days' notice at any time during this three-week period. As specified in Paragraph 10 of the Amended Scheduling Order (Doc. No. 66), the parties shall make all disclosures required by Fed. R. Civ. P. 26(a)(3)(A)-(B) by November 2, 2026 . Objections to those pretrial disclosures shall be made in accordance with Paragraph 10 of the Court's Amended Scheduling Order (Doc. No. 66) by November 16, 2026 . All pretrial materials, as identified in Paragraph 12 of the Amended Scheduling Order (Doc. No. 66), shall be filed with the Court by December 4, 2026 . The parties, through their representatives who have full settlement authority, and their respective counsel shall hold a FACE-TO-FACE meeting to discuss settlement by January 8, 2027 , and shall file a JOINT notification of the results of the face-to-face meeting by January 11, 2027 .
