TEXT ORDER entered by Chief Judge Sara Darrow on September 22, 2023. Pro se Plaintiff Keeler filed a5 Status Report indicating he wishes to voluntarily dismiss this case. Plaintiff requests the Court "voluntarily dismiss the instant case in its entirety without any conditions and to request agreement of the parties and so stipulate that any civil matters between the parties although encountering substantial rough terrain, do not after all rise to a level requiring the litigation of a federal case."5 para 18. No other party has filed an appearance in this matter nor has any party served an answer or motion for summary judgment, so the requested stipulation is unnecessary. Therefore, the Court construes the5 Status Report as a notice of voluntary dismissal. See Fed. R. Civ. P. 41(a)(1)(A)(i). The Clerk is directed to close the case. (KJC) |

The request for injunctive relief is DISMISSED. The remainder of the case is STAYED pending resolution of Keeler's state case. The outcome of Keeler's state case may affect the viability of his claims in this case. See Heck v. Humphrey, 512 U.S. 477, 486-87 (1994) (precluding actions for money damages where doing so would necessarily imply the invalidity of an underlying conviction). Therefore, once the stay is lifted, the Court will conduct another merit review of the complaint. Keeler is DIRECTED to provide the Court with an update on the status of his state proceedings every 60 days. Failure to do so may result in dismissal of this case.
