Fed. R. Civ. P. 15(a)(1). "In all other cases, a party may amend its pleading only with the opposing party's written consent or the court's leave." Fed. R. Civ. P. 15(a)(2). Although Plaintiff may no longer amend his pleading as a matter of course, Plaintiff has obtained Defendant's consent to amend the Amended Complaint (see DE22 at 2). Therefore, the Motion is granted. Plaintiff must separately file in the court record and serve his Second Amended Complaint. See S.D. Fla. L.R. 15.1. The deadline to do so is December 21, 2023. Defendants request for 21 days to respond to the Complaint is denied at this point, and the Defendant should respond to the Second Amended Complaint by January 4, 2024 in accordance with Federal Rule of Procedure 15(a)(3).
