MINUTE ORDER: The Court will hear argument on the8 Motion to Dismiss on July 15, 2024, at 10:00 AM in Courtroom 27A (In Person) before Judge Christopher R. Cooper. Argument will be limited to 90 minutes total. The parties may discuss any issues raised in their briefs, but the Court is specifically interested in hearing from the parties on exhaustion and the alleged Appointments Clause violation. In particular, the parties shall be prepared to answer the following questions with regard to those two issues: (1) How does 21 C.F.R. § 10.45(b) interact with § 10.45(e) with respect to exhaustion of Citizen Petitions? (2) Why don't Association of American Physicians & Surgeons v. FDA , 358 F. App'x 179 (D.C. Cir. 2009), and Center for Food Safety v. Hamburg , 696 F. App'x 302 (9th Cir. 2017), resolve that (a) interested parties are required to exhaust administrative remedies through Citizen Petitions before challenging FDA actions in court; and (b) this exhaustion requirement is consistent with 5 U.S.C. § 704, as interpreted in Darby v. Cisneros , 509 U.S. 137 (1993)? (3) Should the Court excuse any exhaustion requirement in this case? Is there any evidence that the FDA's approval of the MSN generic has substantially harmed Vanda? Does the FDA have any estimated timeline for when it will resolve Vanda's pending Citizen Petition? (4) Assuming exhaustion is required, should Vanda also be required to exhaust its Appointments Clause challenge, or should exhaustion of this constitutional claim be excused either because it falls outside the FDA's expertise or because exhaustion would be futile? (5) Is Dr. Iilun C. Murphy a properly appointed inferior officer? Doesn't the legislative history show that 21 U.S.C.A. § 379d-3a was intended to empower the FDA to recruit and retain expert employees, not appoint inferior officers? Or should the Court place greater weight on the fact that § 379d-3a comports with the Appointments Clause's procedural requirements, see Lucia v. SEC , 585 U.S. 237, 264-65 (2018) (Breyer, J., concurring in the judgment in part and dissenting in part) (suggesting that the "means of appointment that Congress chooses is... instructive")?
