SCREENING ORDER. IT IS ORDERED that the4 motion for extension of time and5 application to proceed in forma pauperis for an inmate are DENIED as moot. IT IS FURTHER ORDERED that the Clerk of the Court send Plaintiff the approved form application to proceed in forma pauperis by a non-prisoner, as well as the document entitled information and instructions for filing an in forma pauperis application. IT IS FURTHER ORDERED that within 30 days from the date of this order, Plaintiff must either: (1) file a fully complete application to proceed in forma pauperis for non-prisoners; or (2) pay the full filing fee of $402. IT IS FURTHER ORDERED, that if Plaintiff does not timely satisfy the matter of the filing fee, dismissal of this action may result. IT IS FURTHER ORDERED that the Clerk of the Court file the 5 -1 Complaint and correct the spelling of the defendant's name from "Nojera" to "Najera" on the docket sheet. IT IS FURTHER ORDERED that, if Plaintiff chooses to file an amended complaint curing the deficiencies of his Complaint, as outlined in this order, Plaintiff will file the amended complaint within 30 days from the date of entry of this order. IT IS FURTHER ORDERED that the Clerk of the Court will send to Plaintiff the approved form for filing a § 1983 complaint, instructions for the same, and a copy of his 5 -1 Complaint. IT IS FURTHER ORDERED that, if Plaintiff fails to file an amended complaint curing the deficiencies outlined in this order, the Court will dismiss this action without prejudice for failure to state a claim.
