JUDGMENT that, pursuant to the Text Order (Dkt. No. 48 ) entered on January 9, 2026 by the Honorable Glenn T. Suddaby, Defendant's letter-motion (Dkt. No.47 ) requesting a ruling on its motion to dismiss Plaintiffs' Complaint with prejudice for failure to prosecute is granted, and granting in part, and denying in part, Defendant's motion to dismiss (Dkt. No.46 ). The Second Circuit has identified five factors that it considers when reviewing a district court's order to dismiss an action for failure to prosecute and/or failure to obey a court order under Fed. R. Civ. P. 41(b): (1) the duration of the plaintiff's failures, (2) whether plaintiff had received notice that further delays would result in dismissal, (3) whether the defendant is likely to be prejudiced by further delay, (4) whether the district judge has taken care to strike the balance between alleviating court calendar congestion and protecting a party's right to due process and a fair chance to be heard and (5) whether the judge has adequately assessed the efficacy of lesser sanctions. LeSane v. Halls Sec. Analyst, Inc., 239 F.3d 206, 209 (2d Cir. 2001). Here, with regard to the first factor, the Court finds that, although the duration of Plaintiffs' failure to comply with U.S. Magistrate Judge Paul J. Evangelista's directive of 09/19/25 (Dkt. No. 43 ) to participate in the hearing of 09/30/25 is only three months, the duration Plaintiffs' failure to participate in discovery is seven-and-a-half months. (Dkt. No.41 , Attach. 2, at 4.) Generally, durations of only four months are sufficient to weigh in favor of dismissal. See N.D.N.Y. L.R. 41.2(a) ("[P]laintiff's failure to take action for four (4) months shall be presumptive evidence of lack of prosecution."); Georgiadis v. First Boston Corp., 167 F.R.D. 24, 25 (S.D.N.Y. 1996) (delay of four months). With regard to the second factor, the Court finds that Plaintiffs have received adequate notice that a further delay would result in dismissal. (See, e.g., Dkt. No.46 , at 5 [attaching Certificate of Service of motion to dismiss for failure to prosecute].) With regard to the third factor, the Court finds that Defendant is likely to be prejudiced by further delay, given the importance of discovery in this action, and the age of the case. See Geordiadis, 167 F.R.D. at 25 ("The passage of time always threatens difficulty as memories fade. Given the age of this case, that problem probably is severe already. The additional delay that plaintiff has caused here can only make matters worse."). Indeed, the Second Circuit has explained that prejudice to a defendant is presumed where the delay is unreasonable (as the Court finds it is here). Lyell Theatre Corp. v. Loews Corp., 682 F.2d 37, 42-43 (2d Cir. 1982). With regard to the fourth factor, the Court finds that the need to alleviate congestion on its docket outweighs Plaintiffs' right to receive a further chance to be heard in this case. With regard to the fifth factor, the Court has carefully considered less drastic sanctions and has found them to be inadequate under the circumstances, especially given Plaintiffs' failure to even oppose Defendant's motion to dismiss (which has lightened the burden on that motion to one of showing only facial merit, pursuant to N.D.N.Y. L.R. 7.1[a] 3 ). Having said all of that, the Court finds that Plaintiffs should be given one FINAL CHANCE to avoid a dismissal of their Complaint WITH PREJUDICE, given the nature of their claims. As a result, the Court DISMISSES Plaintiffs' Complaint WITHOUT PREJUDICE to re-filing by new counsel (should plaintiffs obtain one) within THIRTY (30) DAYS of the entry of this Text Order, after which (if there is no such re-filing) the dismissal shall (without further Order of the Court) be automatically converted to one WITH PREJUDICE.
