ORDER RE: DEFENDANT UNITED STATES OF AMERICA'S MOTION TO DISMISS THIRD AMENDED COMPLAINT140 by Judge Consuelo B. Marshall: Accordingly, Defendant's motion to dismiss is GRANTED as to Counts 13, 14, and 15 under Rule 12(b)(l) without leave to amend and DENIED as to Counts 12 and 16 under Rule 12(b)(6). Defendant's request to strike is GRANTED as to the demand for interest, punitive damages, and attorneys' fees but DENIED as to the demand for a jury trial (with the understanding that this demand does not apply to the FTCA claims). The remaining claims against the government are the FTCA claims for battery (claim 9), assault (claim 10), false imprisonment (claim 11), intentional infliction of emotional distress (claim 12), and violation of the Ralph Act (claim 15).
