The stay ordered on May 10, 2024 is hereby LIFTED and supplemental submissions may be filed by the parties. Defendant's request to limit lifting the stay only for the pending motion to dismiss is DENIED. (Id. at 4.) Defendant has until on or before July 10, 2024 , to submit a supplemental brief addressing Loper Bright Enterprises v. Raimondo, No. 22-1219 S. Ct., 2024 WL 3208360 (U.S. June 28, 2024). Minute Order [non-document] by Judge Bridget Meehan Brennan. Before the Court is Defendant's Motion to Stay Pending Forthcoming Supreme Court Rulings and Alternative Request to Stay Class Discovery. (Doc. No.13 .) Plaintiff filed a response in opposition (Doc. No.17 ), and Defendant replied (Doc. No.19 ). The United States Supreme Court has held that "the power to stay proceedings is incidental to the power inherent in every court to control the disposition of the causes on its docket with economy of time and effort for itself, for counsel, and for litigants. How this can best be done calls for the exercise of judgment, which must weigh competing interests and maintain an even balance." Landis v. N. Am. Co., 299 U.S. 248, 254-55 (1936). Defendant points out that a decision is expected in the remaining time of the Supreme Court's current term regarding the doctrine of Chevron deference afforded to federal agencies acting in their rulemaking capacity. (Doc. No.13 at PageID# 90, 95-96.) See Relentless v. Department of Commerce, No. 22-1219 and Loper Bright Enterprises v. Raimondo, No. 22-451 (both argued on January 17, 2024). Plaintiff argues that this Court could decide the case solely based on statutory text and therefore need not await the Supreme Court's expected decisions regarding Chevron deference. (Doc. No.17 at PageID# 113-14.) Yet Plaintiff's own argument in opposition to the pending motion to dismiss expressly relies on definitions and rules in the Code of Federal Regulations. (Id. at PageID# 118-19.) Plaintiff herself argues: "Beyond the text itself, which serves as the 'starting point' for this Court's inquiry, the Hobbs Act requires that this Court adopt the FCC's interpretation of the statutory text." (Id. at PageID# 120.) This Court concludes that the resolution of Relentless and Loper Bright Enterprises could be informative or perhaps controlling with respect to the resolution of Defendants pending motion to dismiss. (See Doc. No.12 .) Accordingly, this matter is hereby STAYED until the conclusion of the United States Supreme Court's October 2024 term. IT IS SO ORDERED. Order [non-document]: Before the Court is Defendant's Motion for Status Hearing/Conference (Doc. No.15 ). The Motion asserts that the pending Motion to Stay could affect the Motion to Dismiss, "including when and whether [the Motion to Dismiss] is fully briefed, as well as the degree of discovery to take place (if any) in the interim," and that a conference would assist with "orderly briefing" to the current motions. ( Id. at PageID # 108.) In a footnote, the Motion represents that the parties disagree on whether the pending Motion to Dismiss and Motion to Stay should be briefed simultaneously or concurrently. ( Id. at n.1.) Notably, Defendant did not oppose Plaintiff's request for a consolidated response to Defendant's Motion to Dismiss (Doc. No.12 ) and Motion to Stay (Doc. No.13 ), which were filed one week apart. ( See Doc. No.14 at PageID # 104 para. 3.) By agreement of the parties, Plaintiff's consolidated response is due 2/28/2024. (Doc. No.14 ; Minute Order 2/12/2024.) Defendant has not stated a sufficient reason for the Court to entertain a conference on the briefing schedule when they have already agreed to Plaintiff's consolidated response date. Moreover, the Local Rules and this Court's Initial Standing Order (Doc. No.3 , Section V) clearly state the deadlines for reply briefs, should Defendant wish to submit any. If Defendant seeks a consolidated reply date, a motion to that effect can be submitted to the Court for consideration. For these reasons, Defendant's Motion for Status Hearing/Conference is DENIED .
