MINUTE ORDER: DENYING28 Plaintiff's Motion for Leave to Amend. Courts should freely grant pro se litigants leave to amend in the absence of undue delay, bad faith, undue prejudice, repeated failure to cure deficiencies, or futility. Richardson v. United States , 193 F.3d 545, 548 (D.C. Cir. 1999). Plaintiff's proposed amendment is futile because it reasserts the same basis for jurisdiction as the original complaint, which the court already ruled failed to survive a motion to dismiss. See BEG Invs., LLC v. Alberti , 85 F. Supp. 3d 13, 23 (D.D.C. 2015). Plaintiff's amendment must address the defects identified in the court's24 Memorandum Opinion. The deadline for Plaintiff to file a motion for leave to amend is extended until March 10, 2025. The Clerk of Court is DIRECTED to mail courtesy copies of the court's24 Memorandum Opinion,25 Order, and an updated copy of the docket sheet to Plaintiff's current address of record. MINUTE ORDER: Granting Plaintiff's20 Motion for Leave to File Sur-reply. "The Local Rules of this Court contemplate that there ordinarily will be at most three memoranda associated with any given motion: (i) the movant's opening memorandum; (ii) the non-movant's opposition; and (iii) the movant's reply." Crummey v. Soc. Sec. Admin., 794 F. Supp. 2d 46, 62 (D.D.C. 2011) (citing LCvR 7). Here, Plaintiff is the non-movant and "when the nonmovant is deprived of the opportunity to contest matters raised for the first time in the movant's reply, the non-movant may" file a motion seeking leave to file a sur-reply brief. Id. (citing BenKotel v. Howard Univ., 319 F.3d 532, 536 (D.C. Cir. 2003)). Although sur-reply briefs are generally disfavored, district courts may exercise their discretion to grant or deny a motion to file a sur-reply brief. Id. (citation omitted). In exercising its discretion, "the district court should remain cognizant that parties proceeding without legal representation are entitled to a certain amount of solicitude in the conduct of litigation, but also that such solicitude is not limitless and pro se litigants are not relieved of their obligation to comply with the applicable rules." Id. (citing Slovinec v. Am. Univ., 520 F. Supp. 2d 107, 111 (D.D.C. 2007)). Here, Plaintiff has properly sought leave to file her sur-reply brief and it appears to address issues raised for the first time in Defendants' reply brief. On March 8, 2024, however, before the court ruled on Defendants' Motion to Dismiss, Plaintiff filed a18 Motion for Summary Judgment. Plaintiff previously had the opportunity to rebut Defendants' Motion to Dismiss in her Opposition11 Brief. To the extent Plaintiff's claims survive the Motion to Dismiss stage, at that point, the court will order the parties to meet, confer, and set a briefing schedule to move the matter forward.
