Text Order

TEXT ORDER: The Court is in receipt of Plaintiffs' Notice of Filing Consent to Join at ECF No. 6 ("The Notice"). The Notice attaches "Consent to Join" forms signed by Darny Flores (ECF No. 6-1), Plaintiff in this matter, and Yanet Flor Abad Lopez (ECF No. 6-2). As a preliminary matter, the documents at ECF No. 6-1 and 6-2 seem to be incomplete, as they do not name an entity that the individuals seek to sue. ("I hereby consent to become a party plaintiff and make a claim against [BLANK] and related entities or persons for unpaid wages."). As it relates to collective actions under the Fair Labor Standards Act, 29 U.S.C. Section 216(b) states, "[n]o employee shall be a party plaintiff to any such action unless he gives his consent in writing to become such a party and such consent is filed in the court in which such action is brought." While the forms suggest that Darny Flores and Yanet Flor Abad Lopez consent to join the case as Plaintiffs, the form they signed does not contain the Defendants' names, and therefore, leaves doubt as to whether they are aware who this case is brought against. By September 6, 2024, Plaintiff shall refile the notice with signed "Consent to Join" forms containing the Defendants' names.. So Ordered by Magistrate Judge Jose R. Almonte on 8/23/2024. (akw, ) |
