ORDER denying8 Plaintiff's motion to object to magistrate judge. Plaintiff has not provided any support for his suggestion that Judge Farrish's rulings have been "abusive[]," ECF No. 8 at 1, nor that Judge Farrish should recuse himself. Further, Plaintiff need not have filed a consent to magistrate judge jurisdiction for a magistrate judge to preside over this matter consistent with Local Rules 72 and 73 and 28 U.S.C. § 636. Section 636(b) authorizes a district judge to designate a magistrate judge to hear and determine "any pretrial matter pending before the court" with limited exceptions not at issue here. The Court may, as permitted by Section 636(b), refer specific pretrial matters to a magistrate judge without the consent of the parties. The Notice of Option to Consent to Magistrate Judge Jurisdiction at ECF No. 6, on the other hand, refers to the magistrate judge's potential authority to preside over "all proceedings in this civil action including trial, the entry of final judgment, and all post-trial proceedings" beyond that already authorized by Local Rules 72 and 73 and 28 U.S.C. § 636(a). NOTICE OF INSUFFICIENCY. The petitioner has filed a motion for leave to proceed in forma pauperis ; in other words, he seeks to commence a federal habeas case without paying the $5.00 filing fee. A federal law, 28 U.S.C. § 1915, permits him to do so if, among other things, he files an affidavit demonstrating that he is unable to pay the $5.00 fee. To assist inmate plaintiffs in making this demonstration, the Administrative Office of the United States Courts has prepared a two-page application form. The form asks inmates to disclose, among other things, their income for the past twelve months and the sums that they have in cash or in any checking or savings account. In this case, the petitioner has not disclosed his income or account balances. He says that he receives Social Security disability income, but he has not revealed the amount. And when asked to state the amounts in his various accounts, he wrote "not sure." On the basis of these answers, the Court cannot determine whether he is able to pay $5.00. The Clerk of the Court is respectfully directed to mail the petitioner another copy of the application form at his address of record. The petitioner is respectfully directed to fill out the form as completely as possible, including the amount of the Social Security benefit he receives each month. With respect to Question 4, the Court understands that, as an incarcerated person, the petitioner may not know the exact balances of any outside-the-prison checking or savings accounts that he may have. But he should provide his best guess and he should also provide the balance of his inmate trust account, because he no doubt has access to that figure. The Court wishes to be clear that it is not denying the petitioner's in forma pauperis application at this time. It is merely (a) saying that the petitioner has not yet provided enough information to enable the Court to conclude that he is "unable to pay," and (b) giving the petitioner another opportunity to provide that information. If, however, he does not return the completed application form to the Clerk of the Court by May 15, 2024, he will have neither paid the filing fee nor demonstrated an entitlement to in forma pauperis status.
