ORDER STAYING CASE. In light of the pendency of Petitioner's direct appeals in the underlying criminal case, which includes the issues giving rise to the instant Petition, see United States v. Matava , 24-886 (2nd Cir. 2024); United States v. Matava , 24-112 (2nd Cir. 2024); United States v. Matava , 24-1132 (2nd Cir. 2024), the Court sua sponte stays this case pending the resolution of Petitioner's appeals. See United States v. Jiau , 536 F. Appx 140, 142 (2d Cir. 2013) (acknowledging that a district court possesses the inherent power to stay the adjudication of a Section 2255 Petition pending resolution of a direct appeal); United States v. Vilar , 645 F.3d 543, 548 (2d Cir. 2011) (noting that judicial economy generally favors the resolution of a direct appeal prior to the resolution of a habeas petition). If the Defendant succeeds on his direct appeals, it is self-evident that there would be no need for a collateral attack on the Court's orders (or by extension the judgment) through this habeas corpus petition.
