ORDER denying 23 Motion for Reconsideration. "The standard for granting [a motion for reconsideration] is strict, and reconsideration will generally be denied unless the moving party can point to controlling decisions or data that the court overlooked - matters, in other words, that might reasonably be expected to alter the conclusion reached by the court." Shrader v. CSX Transp., Inc. , 70 F.3d 255, 257 (2d Cir. 1995). The Court finds that Plaintiff Wozar did not meet this standard and thus, his motion is denied . In response to Plaintiff Wozar filing a Complaint consisting of over one hundred pages, Attorney Tallberg publicly filed a request for an extension of time, representing that he was "still in the process of identifying and attempting to collect necessary information and documents" to "investigate the allegations in plaintiff's complaint." (ECF No. 21 .) Accordingly, there was good cause to grant the extension. Moreover, because the request was publicly filed on the docket, the Court finds that Plaintiff has not shown that Attorney Tallberg engaged in ex parte communication. The Court acknowledges Plaintiff's desire for the "matter to be concluded as soon as possible." (ECF No. 23 at 4.) In light of defense counsel filing a notice of appearance, the Court encourages the parties to meet and confer to explore the potential for settlement. It is so ordered. Signed by Judge Vernon D.
