ORDER: The Court is in receipt of the Niayzov Defendants' counsel's letter91 renewing the motion to withdraw75 as to Juda Niayzov, Alevtina Ioffe, and Exclusive Properties Realty, Inc., and requesting time to reply to Plaintiffs' response76 . The motion to withdraw75 is granted, for the reasons stated in the motion, on the record in the April 24, 2025 conference, and in the status report91 . Counsel's request for additional time to respond to Plaintiff's reply is denied as moot. The Niayzov Defendants are directed to have new counsel enter their appearance by 6/20/2025 . In the event new counsel does not appear, Mr. Niayzov and Ms. Ioffe must each send letters to the E.D.N.Y. Pro Se Office (at the address below), with their contact information, including their address, phone number, and email address, and indicating their intent to proceed pro se on their own behalf. In addition, should either Defendant determine to proceed pro se , he or she may consent to electronic service of orders and notices issued by the court by completing a form available at [LINK:https://www.nyed.uscourts.gov/forms/pro-se-registration-and-consent-electronic-service-orders-and-notices-issued-court-civil-cases] and mailing the form to the E.D.N.Y. Pro Se Department, 225 Cadman Plaza East, Brooklyn, NY 11201. Additionally, the City Bar Justice Center provides free, confidential, limited-scope legal service to pro se litigants at the Brooklyn Federal Courthouse. Failure to have new counsel appear or to appear pro se may result in that Defendant being found in default. As to the corporate Defendant, Exclusive Properties Realty Inc., the Niayzov Defendants are respectfully reminded that "[a] party that is a corporation must be represented by counsel in order to appear in this Court." See [LINK:https://www.ca2.uscourts.gov/clerk/case_filing/appealing_a_case/civil_case/representation_of_a_corporation.html] ; 28 U.S.C. § 1654; Berrios v. New York City Housing Authority , 564 F.3d 130, 132-133 (2d Cir. 2009). Failure to have counsel appear for the corporate Defendant may result in the corporate Defendant being found to be in default. The discovery deadlines as to the Niayzov Defendants are temporarily stayed until 6/20/2025 , but the Niayzov Defendants may participate in depositions and other discovery between now and 6/20/2025. The Clerk of Court is respectfully directed to terminate Christopher Paul DelCioppio, Luigi Brandimarte, and Patricia Rose Lynch of Sacco & Fillas as counsel of record for Defendants. Outgoing counsel is directed to forward a copy of this Order to Defendants Niayzov and Ioffe and to file proof of same on ECF by 5/23/2025 . In addition, the Clerk of Court is also respectfully directed to mail a copy of this Order to the Niayzov Defendants at 16 Duffield Drive Ocean, New Jersey 07712.Ordered by Magistrate Judge Taryn A.
