Order on Motion to Stay
Fri 04/25 8:56 AM
ENDORSED ORDER. On April 18, 2025, Plaintiff moved to stay the proceedings in this matter. ( See Dkt. 26 .) Her Rule 3.01(g) certification indicated that she had "attempted to confer with counsel for Defendant[]," but had not received "confirmation of Defendant['s] position" as to her motion by the time of filing. ( Id. at 3.) Plaintiff was therefore required to "try diligently for three days to contact the opposing party" to determine its position to the motion, and, upon "expiration of the three days," to "supplement [her] motion with a statement certifying whether the parties ha[d] resolved all or part of the motion." M.D. Fla. R. 3.01(g)(3). Because Plaintiff has failed to file the required supplement, her motion is denied without prejudice. See id. ("Failure to timely supplement can result in denial of the motion without prejudice."). Signed by Judge Julie S. Sneed on 4/25/2025. (JWM) |

ENDORSED ORDER. In light of Plaintiff's motion to stay, the court sua sponte extends Plaintiff's deadline to file a second amended complaint. See Fed. R. Civ. P. 6(b)(1)(A). Plaintiff may file a second amended complaint on or before May 9, 2025. Moreover, it appears that Plaintiff's former lawyer, Anthony Georges-Pierre, is still representing Plaintiff despite having been previously permitted to withdraw from this case. ( See Dkts. 24 , 26 .) Mr. Georges-Pierre is DIRECTED to file a notice as to whether or not he is still representing Plaintiff in this matter. Signed by Judge Julie S. Sneed on 4/22/2025. (JWM) |

ENDORSED ORDER. Because Plaintiff is now proceeding pro se in this matter, ( see Dkt. 24 ), the court sua sponte extends Plaintiff's deadline to file a second amended complaint. See Fed. R. Civ. P. 6(b)(1)(A). Plaintiff may file a second amended complaint on or before April 25, 2025. Plaintiff is advised that failure to timely file a second amended complaint will render the court's order dismissing her complaint without prejudice, (Dkt. 22 ), a final judgment. See Auto. Alignment & Body Serv., Inc. v. State Farm Mut. Auto. Ins. Co. , 953 F.3d 707, 720 (11th Cir. 2020). Signed by Judge Julie S. Sneed on 4/10/2025. (JWM) |

ENDORSED ORDER striking Plaintiff's Second Amended Complaint (Dkt. 16) for failure to comply with Federal Rule of Civil Procedure 15(a). Because Plaintiff has already amended her complaint once as a matter of course under Rule 15(a)(1), she may amend her pleadings only with the opposing party's written consent or the court's leave. See Fed. R. Civ. P. 15(a)(1); Logue v. Patient First Corp., 246 F. Supp. 3d 1124, 1126-27 (D. Md. 2017) ("The court emphasizes the last phrase of Rule 15(a)(1)(B): 'whichever is earlier.' The singular nature of that phrase reinforces the leading phrase, 'A party may amend its pleading once as a matter of course...,' to mean only one opportunity is afforded by Rule 15 to amend any pleading as a matter of course. Once means once."). Upon review of the docket, it does not appear Plaintiff obtained the opposing parties' written consent nor the court's leave to amend her pleading. Signed by Judge Julie S. Sneed on 12/20/2024. (JWM) |
