ORDER- Because Plaintiffs sought to amend within twenty-one days of the filing of Defendants Rule 12(b)(6) Motion to Dismiss, the amendment is therefore timely as of right, and the Court GRANTS the Plaintiffs' Motion to Amend (ECF No.10 ). Although Plaintiffs did not submit an Amended Complaint with their Motion, out of deference to Plaintiffs' pro se status, the Court ORDERS that the Complaint (ECF No.1 ) is hereby constructively amended to include the above-quoted language. In light of the above and further in light of Defendant's subsequently filed Motion to Dismiss the Amended Complaint, ECF No.13 , the Defendant's Motion to Dismiss the original Complaint (ECF No.4 ) is DENIED AS MOOT. The Court further DENIES AS MOOT the pending Motion for Extension of Time to File Reply (ECF No.11 ) and Plaintiffs' Motion to Deny the Defendant Extension (ECF No.20 ).
