8 | 8 TEXT DETENTION ORDER as to Elbio Byron Cuz Chub. Based on the evidence and information received during the detention hearing, the court finds pursuant to 18 U.S.C. § 3142(e) that the government has shown by a preponderance of the evidence that no condition or combination of conditions will reasonably assure the defendant's appearance as required, and by clear and convincing evidence that no condition or combination of conditions will reasonably assure the safety of any other person and the community, if the defendant is released on bond pending trial. These findings are based on the reasons articulated on the record during the detention hearing, including the following: the nature and circumstances of the offense charged, which involves a firearm, as well as the related state charge for first degree assault; and the defendant's prior failure to appear for immigration proceedings and the DHS ICE detainer pending removal. The court orders that the defendant shall be detained pending final resolution of the charges or further order of the court, and is committed to the custody of the Attorney General or his designated representative for confinement in a corrections facility separate, to the extent practicable, from persons awaiting or serving sentences or being held in custody pending appeal. The defendant shall be afforded a reasonable opportunity for private consultation with defense counsel and, on order of the court or on request of an attorney for the government, the person in charge of the defendant's corrections facility shall deliver the defendant to a United States Marshal for the purpose of an appearance in connection with a court proceeding.
