TEXT ORDER: On November 4, 2025, the Court held a pretrial hearing (the "Hearing"). Based on the discussion on the record at the Hearing, as well as the Letter filed on November 5, 2025 (Doc. 13), a trial shall proceed as an in-person evidentiary hearing on December 9, 2025 at 10:00 a.m. at the James M. Hanley U.S. Courthouse and Federal Building, 100 South Clinton Street, Syracuse, New York (the "Courthouse"). A Joint Stipulation stipulating to as many of the relevant, undisputed facts as possible to be acknowledged by all parties, and each party's Witness List and a Summary List of Exhibits are to be filed with the Court by 12:00 p.m. on November 25, 2025; and three (3) copies of any exhibits are to be received by the Court by 12:00 p.m. on November 25, 2025. The exhibits shall all be pre-marked, assembled in binders or bound, and appropriately tabbed or otherwise identified. Plaintiff shall identify exhibits using letters and Defendant shall identify exhibits using numbers. Objections to either exhibits or to a witness testifying are to be filed with the Court by 10:00 a.m. on December 2, 2025. A final pre-trial conference will be held on December 3, 2025 at 10:05 a.m., which will be held either in-person at the Courthouse OR by video via Teams, for which pre-registration is required by 3:00 PM one business day before the hearing.
