The motion for default judgment filed by the plaintiffs, Michael Donovan and Darrin Golden, against defendant Richard W. Reid Electrical Company, Inc., ECF 11 , is DENIED. Where "the plaintiff's claim is for a sum certain" and is supported by "an affidavit showing the amount due," default judgment may, "on the plaintiff's request," be entered without a hearing. Fed. R. Civ. P. 55(b)(1). The plaintiffs' motion is not supported by such an affidavit. Donovan's affidavit identifies the relevant employer as "E.H. Electric & HVAC LLC" and attests that this employer "has been delinquent in payment of benefit contributions for 24 months." ECF 13 , 2-3. The complaint, however, was filed against Richard W. Reid Electrical Company, and it alleges that Richard W. Reid "has failed to pay benefit contributions and wage deductions for the months of August, September, October, November, and December 2024." ECF 1 , � 17. The plaintiffs' memorandum similarly asserts that Richard W. Reid "has been delinquent in payment of benefit contributions for a full nine months - since August of 2024," yet cites to Donovan's affidavit. ECF 12 , at 2. Given these inconsistencies between Donovan's affidavit, on the one hand, and the complaint and brief, on the other hand, the Court lacks a reliable evidentiary record on which to conclude that the requested default judgment amount of $320,820.45 is accurate. See ECF 13 , 4. The plaintiffs' motion itself claims to seek default judgment against Richard W. Reid on the first page, but against E.H. Electric & HVAC LLC on the second page, and it also identifies three different default judgment amounts: $320,820.45, $321,678.895 [sic], and $805,594.83. ECF 11 , at 1-2. Accordingly, the motion is denied without prejudice to the filing of a renewed motion that includes an updated supporting affidavit that identifies the correct employer and properly "show[s] the amount due."
