DOCKET TEXT ORDER. Defendant seeks to dismiss Plaintiff's Complaint, which it removed from state court, on the basis that it does not meet the federal pleading standard under Federal Rule of Civil Procedure 8, Ashcroft v. Iqbal, 556 U.S. 662 (2009), and Bell Atlantic Corporation v. Twombly, 550 U.S. 544 (2007). Alternatively, the Defendant asks the court to order that Plaintiff be required to provide a more definite statement pursuant to Rule 12(e). Of course, when Plaintiff filed his Complaint in state court, he was not required to meet the pleading standards that apply in federal court. Accordingly, the court finds it appropriate and in the interest of judicial economy to allow Plaintiff to amend his Complaint. Plaintiff is hereby GRANTED twenty-one (21) days to file an amended complaint. Defendant's motion (ECF No. 4 ) is hereby DISMISSED from the docket without prejudice to file a motion addressed toward Plaintiff's amended complaint at the appropriate time.
