Determination of whether defendant will qualify for appointed counsel or will need to contribute will be determined, in part, by the outcome of the detention hearing. Detention Hearing as to Darryl Lamont Paul held on 3/18/2025. The government proceeds by proffer. Defendant places his arguments on the record and requests release upon the conditions recommended by pretrial services. In addition, defendant can reside with mother at her home and she is willing to post home. The Government places its objections on the record. The court interviews defendant's mother. She confirms she understands the risks involved, and is willing to act as a surety and post her home. She confirms the approximate value of her home and the encumbered amount. She agrees to notify the court of any violation. The court tentatively orders defendant to be released upon conditions that the unencumbered value of the home is at least $100,000. Defendant is to provide information concerning the home for the governments' review on or before March 21, 2025. The defendant will not be released until the government is satisfied with the property posted. The government alerts the court to Second Circuit authority concerning whether financial sureties can assuage the risk of danger. The government may submit its authority to the court by the end of business today, March 18, 2025. The defendant may respond on or before March 21, 2025. The court places additional conditions of release on the record concerning female visitors to his mother's home, and limitations on the business activities in which defendant will be permitted to engage. Defendant is to provide the court with additional information concerning defendant's expected income under these conditions. | 9 | 9 TEXT ORDER as to Darryl Lamont Paul: As agreed to by the parties, pursuant to Fed. R. Crim. P. (Rule) 48(b), the Complaint will be automatically dismissed, without prejudice, on June 26, 2025 at 12:00 p.m. without the need for a further order. The Rule 48(b) deadline will not be extended for ongoing plea negotiations short of an actual plea agreement. Defendant may accelerate the Rule 48(b) dismissal deadline by filing a notice to that effect, in which case the dismissal will occur (without further order) at 12:00 p.m. on the 10th business day thereafter; provided, however, that in no event will the dismissal occur less than 30 or more than 90 days from today's date, unless extended by the court for reasons other than ongoing plea negotiations. Any defendant who is in custody on the Complaint and not subject to another detainer or warrant at that time of the dismissal shall immediately be released from custody, and the conditions of release (including bail) imposed as a result of the Complaint as to any defendant who is not in custody at that time shall immediately terminate. For the reasons stated by the government and agreed to by defendant, the ends of justice served by this continuance outweigh the best interest of the public and defendant in a speedy trial, and the time between today and June 26, 2025 is therefore excluded from the Speedy Trial Act calendar pursuant to 18 U.S.C. DECISION & ORDER (from 25-MR-176) re10 APPEAL OF MAGISTRATE JUDGE DECISION as to Darryl Paul (1). For the reasons in the attached decision and order, this Court finds that the government has sustained its burden of establishing by clear and convincing evidence that Paul poses a danger to other persons and the community and that no condition or combination of conditions can reasonably assure the safety of those persons and the community.
