ORDER by Magistrate Judge Mark D. Clarke: The parties have presented a discovery issue to the Court via informal letters. Plaintiff has produced certain requested discovery by printing the relevant e-mails and text messages and sending them to Defendant as flat PDF files, without any corresponding metadata. Defendant objects to the format of this discovery. The Court resolves the dispute as follows. When requesting production of Electronically Stored Information (ESI), a party may specify the form or forms in which electronically stored information is to be produced. FRCP 34(b)(1)(C). If a request does not specify a form for producing electronically stored information, a party must produce it in a form or forms in which it is ordinarily maintained or in a reasonably usable form or forms. FRCP 34(b)(2)(E). While the Plaintiff has objected to the financial burden that would be imposed by the Defendant's requested format of the ESI at issue here, there is no indication that simply producing the ESI in the native format, with basic metadata intact, would be overly burdensome. Additionally, this native format is how text message and e-mails are "ordinarily maintained," and therefore such a format is required by the rules. There is also no burdensome time constraint, as the time for discovery does not close for many months. Therefore, Plaintiff shall produce the relevant text messages, e-mails, and other communications, in their native format, with intact metadata, within a reasonable amount of time. (jk)

SCHEDULING ORDER. RECORD OF ORDER by Magistrate Judge Mark D. Clarke: RESETTING the telephonic Rule 16 Conference from 04/27/2026 at 9:00 AM to 05/04/2026 at 11:00 AM. Conference call information remains the same as previously provided. At the time of the Conference, parties should have their calendars available to discuss scheduling matters, including modification of the current case deadlines, joining additional parties and amending the pleadings, dispositive motions, and setting a trial date. The parties shall consult pursuant to FRCP 26(f) regarding a focused and proportional discovery plan prior to the Conference. A written report is not required. However, the parties should be prepared to briefly summarize the issues in the case and give the Court a realistic picture of what discovery needs to be completed.
